The husband has filed bankruptcy 6 months ago but the wife did not. the problem now is she is wanting a divorce and the 1st mortgage is in her name and the 2nd is in his name. she also stupidly put other large debts in her name only along the way the last 5 years. she has 4 kids, should she divorce 1st and then go into bankruptcy or what. He treatens he will not help at all if she does! I mean pay the second. thats what keeps her tied to him.... Now that his bankruptcy is final he spends as he sees fit! what to do???? She cannot stand this to go on. As her brother I told her not to move out of the house! Her husband believes it is her duty to take care of all of the house and yard , plus work outside the home while he races his cars and pertisapates in his other hobbies with his father and brothers!!!!!!!!!!! She would be silly if she moves out of the house. First, she needs a good divorce lawyer before she decides anything right now. Are the children his or from a previous marriage? If his he will be made to pay child support for them. She should have kick his lazy butt to the curb 5 years ago. A woman doesn't understand these days not to put the debts just in her name. She needs to first get all her papers together and then tomorrow morning first thing start looking for the right lawyer. I would wait to do anything until I talked to one.

First off how did he file without her while they were married? 2nd I think because they were married when he filed her credit is now ruined for the time being as well. Tell her to go see an attorney, they will do a free consult, they will be able to give her insight on the situation she will be in, also he should just get the boot now if he is not helping with anything.
Sucks for the woman and all her kids to have to deal with this idiot.

Your sister sure chose a choice *ssole of a man!
She needs to file on him asap.
He shouldn't live in that house regardless of the fact he's her soon to be gone husband.
