if a different person (ex: mr. bush) had a heart attack in the very same alley and you did not have the 357, would you make any attempt to revive him (unless your a medical professional you have no legal obligation to do so) ?

For failure not to help a dying person, you be charged of a crime under the Penal Law. In this connection, you are duty-bound to help someone who is under a heart attack.
