No. It's illegal to block a driveway. If you have insurance - I hope - let your insurance co. handle it and don't talk to anyone until you talk to them.

I was involved in an accident similar to this. The car was parked across the street from my drive in the rd and we have narrow roads in the town I live in and the lady turned it into my insurance and it is still pending on it. so as far as I know they may say u r @ fault for improper backing but if the truck was blocking your drive parked then i don't think so.

Depends on the circumstances. Was the truck moving, or parked? Was your vision blocked by something, or did you have unobstructed view of the road? Hard to say without more details. But if you're pulling out, it is usually your fault, even if the view is blocked by trees, other cars, etc., because you need to yield the right of way to cars and trucks moving, they can't tell when YOU are coming out, but you know cars on the road are always MOVING, so you must yield to them. Unless they were exceeding the speed limit at an extremely high rate, then it might be their fault for giving you no time to adjust if you're pulling out due to their excessive speed. But that's about the only time it wouldn't be your fault.
