My brother stole my checkbook, & I have more checks. Would it do harm if I wrote in a different check # out of place? I need to pay my rent.

You can write your checks in any order that you want. The numbers are for your convenience only.

I hope you filed charges against your brother - of course I guess if he doesn't use them, he can always lie and say he doesn't have them.

No, you don't have to write checks in numerical order.
If I was you, though, I would close and reopen your checking account with a different account number as soon as possible and close out your old account. The stolen checks can be used fraudulently months or even years from now. Just issuing a stop payment on the range of checks will cost you way more in fees than you want to pay.
Around here, a tactic that burglars use is to steal a pad of checks from the middle or bottom of the box in hopes that you won't notice them missing until it's too late.
When you go to the bank to change your account number, buy a cashiers check / bank check / money order to pay your rent.

nope, not compulsory at all. however, you'd better call your bank and get a new checkbook/account number if you don't want your brother to steal your money with the ones he stole.

Have your bank issue 'stop payment' on all checks he has...doesn't matter what order they are in either.
