we owe hundreds of thousands in medical bills, and my wifes condition is terminal. the nerves in her stomach were cut, and she had to have it removed. we won our lawsuit, but my insurance provider took our settlement leaving us to fend for ourselves. I agree that they should not have had to pay for this doctors mistake, but I should not have had to pay either. They took our rights away, and it is not right what they did to my family. I will never recover from the hole that they put me in. this could happen to any of you. what do you think of this situation.

the insurance sent me a formula for a payback to them. the more that we won the more that they would take. They said that we owed them 1.8 million dollars, and the most that we could win under wv law was 2 mill. we settled for 1 mill. they took 700,000, the lawyer got 280,000, and we got 20,000. that did not even pay off our medical bill's at the time. it is a bad situation that i would not wish on anyone. the doctor did have to leave our area, but went to another state to set up a new practice.

You need to get some legal counsel and go after the insurance company. Your award should have been significantly larger than just the cost of the medical bills (what you would have to pay the insurance company). Something sounds funny here.

A state law that limits malpractice lawsuits?
Firstly, your attorney should have put you on notice that this would/could happen, unless the attorney was also provided by your insurance company.
Secondly, as a footnote, don't try paying medical bills at 5 or 10 dollars a month. Doctors nowadays send your bills to collection agencies and ...well, by now, you probably know the rest.
I can't believe the states have put themselves in bed with the insurance companies. You would think there is a conflict of interest there.
Please tell your wife that she is in our prayers.

I am so sorry for both you and your wife. What a terrible thing to happen! And then for you still to be in debt for medical bills resulting from what the doctor did despite having insurance and winning a law suit. This is so wrong! Where is justice?

It sounds like you should have sued for more $$. Any chance you could go after the insurance company?

Why did your insurance provider take your settlement????? They're supposed to PROVIDE you insurance, not steal your money. Have you had a lawyer look into the laws surrounding the Insurance company taking your money? (Any lawyer worth his salt will look at a case for free if he thinks he has a chance to win the case and get some money for it.)
This just sounds fishy.

I would contact your state's insurance commission and explain to them what you just told us. They should at least look in to the situation for you. As you know now, your mistake was to settle before knowing the full extent of your wife's problems. Your only other option would be to declare bankruptcy. Good luck.

I think that this was a terrible thing to happen. I really think you need to talk to a lawyer and see if any thing else can be done. There is also malpractice/neglegence suits you can file. I wish you all the luck.
