The other day a storm blew over my tree onto my neighbor's yard. There was no property damage. Who is responsible for removing the tree?

I would think it would be your responsibility to remove your tree from your neighbor's yard. Or else, they could pay to have it removed and then send you the bill...or possibly take you to court to recover the expense of having the tree removed.

All in all, it's the "right thing to do" to take care of your tree, regardless of what the law says.

If the tree was dead and posed a danger to anyone's property then you can be held liable for any damage. If it was healthy, it depends on what state you are in. Often, insurance companies do not pay any claims for any resulting from 'an act of God'.

I agree with the majority. It was your tree and in your yard. To be the good neighbor and do what is ethically right, I'd say start cleaning up the tree.

Legally, not sure, but I would think the neighbors would also want the tree and roots off their property too. They'll have to pay someone to remove it from their side, and since the tree is still in on piece, they'll have no choice but to remove it from your property. My guess is they are required to move it. Take photos of the tree and broken fence so you have them for insurance purposes. That is a really large tree for you to have to remove, and it will be somewhat costly for the right people to move it; I am guessing their homeowners would cover it. Maybe yours can partially cover the expense too.

Your's. You could have cut the tree down but didn't. Your neighbor wouldn't have been legally permitted to do so. You are responsible for the damage caused by this choice.

BTW if your tree drops on my property, it is still your tree. If you drop a $100 bill on my property, that sucker is MINE!!

I just wanted to be clear about that.

I agree with firstythirsty there!
But here's a thought, invite the neighbor to help you, and then afterward throw a BBQ for all involved! If your going to be living there for some time, try to get along with the neighbors, because then the whole neighborhood benefits when everyone is kind of watching out for each other.

you are if the tree was on your property. You own it. Call your Homeowners Insurance company and see if you can make a wind damage claim to help pay for the removal..Or go buy a small chain saw and do it yourself.

You would be because it was your tree. It doesn't matter where it falls. If I drop a $100 dollar bill in your yard, it's still my $100 dollar bill.

It was your tree, so I would go with you have at least some responsibility.

If there is a fight about it though, you can claim act of god. Good luck...

Put it this way though. You will have a lot of fire wood to either use or sell.

Depends on what state you are in. It is their yard and an "act of god" has cause the tree to fall, they clean it!
