Heres the story my boyfriends car was searched by the cops, they found nothin but empty baggies and 2 pipes. no weed waht so ever. he was given a ticket and charged with


penal code11357.
(b) Except as authorized by law, every person who possesses not more than 28.5 grams of marijuana, other than concentrated cannabis, is guilty of a misdemeanor and shall be punished by a fine of not more than one hundred dollars ($100).



they didnt find weed on him though. so is that the right? or his supposed to be charged with somethin else?

go here: www.norml.com and look up your state's laws. Could be there was residue left in the pipes and/or the baggies, but the amount would be insignificant. The laws in your state will tell you what to expect. He could have been charged with paraphernalia (good job spelling, Daniel!) in addition to possession, but his possession charge is most likely a misdemeanor if he was only ticketed.
Rule number one for tokers: Only break one law at a time. If you're carrying anything, drive smart, obey traffic laws and there'll be no reason to get pulled over.

In some states he can be charged with possession of drug paraphernalia (sp?). But in this case I bet there was some residue from prior use. That would be enough for the stated statute to take effect.

The pipes most likely had resin in it, thus causing your boyfriend to have "not more than 28.5 grams of marijuana".
