My little brother was driving to the airport to fly to Florida with a friend to visit my brother when he was hit by a woman who blew a red light. Everyone in his vehicle was wearing seatbelts and they were properly insured and registered. The other car, however had 8 people in it, 4 adults and 4 children, none of which were wearing seat belts, no one in the car had a drivers license and the vehicle was not insured at all. No one in the vehicle that struck my brother was injured, everyone in my brothers car was taken away on stretchers. Also, my brother was supposed to leave for the Navy in 3 weeks, but he sustained such a serious knee injury from the accident that they don't think he's eligible anymore to join the service. A young man, answering his countries call to war, seriously injured by a negligent idiot who may have snuffed out his carreer before it ever started. Furthermore, he is a National Karate Champion for over seven years running, now he can't move his leg. Help.

Aside from the legal ramifications, no driver's license, probably ticket for no seat belts, no insurance, and any other charges, this is strictly a civil matter now.
He will have to sue the other party and collect whatever he can. Wages can be garnished in some states.
Try to find an attorney to take the case on a contingency basis. That may be difficult if the other driver has little or no assets.

It is a drivers responsibility to be insure, and it is very illegal not to be.

I am assuming since there were medics on the scene there were also police. It would be fair to assume there is a police report outlining the liability and no doubt charges have been laid against the other driver.

From here sue. Retain the services of a good lawyer and take the irresponsible driver for all they are worth and more.

Any claims in opposition to your brother are in opposition to him and no longer your insurer. If your brother has agreed to permit the insurer to behave on his behalf then they don't seem to be doing a well process for him! I'm so sorry for your brother. I can understand your frustration, but I don't think there is anything you can do, except be there to support your brother. He will really need your emotional support to deal with all of the disappointments of not being able to serve his country and possibly never being able to use his leg properly. The idiots will have to deal with the law. I know that sometimes that doesn't seem like it's enough, but it has to be. Your brother needs you to be at his side emotionally.

Sorry to say that since they were not insured then theres not much you can do except try to sue them for his damages and losses and injuries. Suing someone in a case like this can be risky though because there of course is no garuantee that these people have any money to pay anything. I know its not fair and it is so fustrating... Im so sorry for your brother and all he's going through.

I don't think theres much that you can do, but I'm sure that your brother will receive a good amount of money for his injuries, especially since the other driver didnt have a license.

I am so sorry but there is nothing we can do just like there is nothing you can do. We can lobby the government for stricter laws on unlicensed, uninsured drivers but it wont help your brother.
