My husband and I want to start our own business doing what we do now. We signed a no compete paper saying we couldn't do this for 20 years after we stoped working here or for a distance of 300 miles.

Once your signature is on the document, it is legal and binding, with or without a notary stamp or signature.

Not all legal documents require notary. In fact, a verbal non-compete should even be binding in most states.

But understand this: a contract represents an agreement. If both parties agree to no longer recognize the contract then it is no longer binding. So talk to the employer. Say this is what we would like to do and even though we are way in another area we feel it is in good integrity to raise this issue. Would you please release us from this non-compete.

I've seen multi-billion dollar corporations answer "yes."

Yes in most areas the "no Competition" clause is enforceable. Employers do this to prevent people they hire from learning their business and then leaving and competing against them. Please understand that in many states even a verbal agreement is as binding as a written contract. Contact a lawyer for more information.

That depends upon the exact language.. non-competes are fairly easy to get out of though, I'd be surprised if it could be enforced.
