If they present a clear danger to the lives of people in your home, most assuredly. But, be sure he is a Martian. You wouldn't want to make a mistake and shoot at your neighbor from Neptune. You know how they like to sue at the drop of a hat.

Do you have the legal right to kill people if they were snooting around in your backyard? If so, then I guess you could shoot Martians too. If there were any.

It depends on the law in your community. Some states and provinces have made it illegal to use deadly force unless you are in grave physical danger (so the Martians would have to be attacking your physically or shooting at you).
But you could probably hurt them to get them to leave or stop, but you could leave yourself open to a assault lawsuit (people just love to sue others these days - ever watch Judge Judy?).
