heres what happened. an aquaintace i knew had me drive b/c they were drunk & so were my other buds. got into small accident w/ them in it,& now wants me 2 pay. dont think its my fault, heres why: If u smoke cigs u are @ risk of cancer. if you die of cancer b.c cigs is it the cig co. fault or the smoker? its the smoker because of ignorance. which is why they keep thriving. i feel it was their ignorance of lettin me drive, they shouldnt have goten drunk. when i was 16, my dad had me drive cuz he was drunk. i was pulled over for running a red light and given tickets 4, no license, no seatbelt, runnin red light, yet it was revoked at court because it was my dads IGNORANCE of letting me drive. HERES MORE. Its been 6 months since the accident & now she calls bout money. she says it because she needed money 4 brakes. 1st why did she wait so long, she musta felt like it was her fault. 2nd, fact she wants money 4 brakes is like sayin, u hit my car & i want money for a cat. wat do u think. aloha

Sorry, but it sounds like it is completely your fault. You are calling your friend ignorant for allowing you to drive. Well, you are at fault there, unless they had a gun to your head.

The 16 thing, you were a minor, that is why they blamed your dad, even though you still were at fault.

Stop blaming everyone else for your mistakes. Just deal with it.

Your present case is different from your previous case when you were a minor.

If you have a valid driving license and if the accident is not due to your negligence, you are not at fault and you need not pay. Your friend's car must be insured and should cover any liability to a third party if applicable.

If you too were drunk, then the situation would be different.

I am not a lawyer but if you give me the full facts can advise you better. Or consult a lawyer if need be.

Legal and ethical issues are different and should be treated differently.

If you were driving at the time of the accident, part of the fault rests on you.

You can't go blaming everyone else just because you got behind the wheel, turned the key and started driving. You're not legally obligated to put yourself in a position you can't get out of, and just becaues someone else got drunk doesn't mean you have to do shiat for them.

Sounds like 6 months later for the brakes is a scam. Tell her she should have figured that out with her insurance company LONG ago.

Absolutely deserve a ticket. I am very biased in favor of doing anything possible to keep drunks off the road. I work the evening shift, that means I drive home every night at "drunk thirty". I agree with you that not all drunk drivers are bad people ... but at the same time every time they pour themselves behind the wheel after spending hours in a bar, they are endangering me and every other driver on the road. They also endanger every person living near a road. You know three people that drove drunk, 1 died and the other 2 "learned their lesson". I used to work in an emergency room ... I saw the other side. A woman that was driving a car from her wedding to her reception ... t-boned by a drunk driver, 2 hrs married and she was a widow. A retired Marine, served two tours in Vietnam, came home without a physical scratch, Went for a run (to stay in shape) one evening ... and came to the ER with injuries caused by a drunk driver. A female military dependent just hanging out at home watching TV ... Drunk driver's car rolled right through her bedroom. No injuries to her ... but the house was declared not fit for habitation. And I could go on, hundreds of cases that I saw myself or heard about from someone that was there. Loss of life, severe injuries [some requiring amputation] loss of property, etc. Do I think that all of these drunk drivers meant to harm someone? I doubt any of them wanted to harm anyone! Their actions had extreme consequences for other people, and at least some consequences for them. I don't HATE drunk drivers ... I just want them knocked down hard enough that they have good reason to NEVER do that again!

You won't like my answer, but I believe you're at fault. When you agreed to drive, you took responsibility for doing it safely. I know that you were doing them a favor, and may, in fact have saved their lives. But if you weren't capable of driving safely, you should have refused, and called a cab, or called someone who could help out safely.

Now, if the accident had happened because the brakes were bad, and you didn't know that, it's a different story. In that case, the accident would not have been your fault because you were not negligent. In fact, you would have a cause of action against the owner of the car for not informing you of the danger.

1st off id like to say that hey u mighta saved someones life, but yea u coulda called a cab. in this situation it seemed like it took 2 for this 2 happen ( or more) the fact that she wants money to pay her brakes is ridiculous. if she has no estimate, dont pay. get ger to email why she wants money or get a recording. it will help in court, they might tell u to pay for a brake job only. its really in the judges hands.

Your fault.

You drove, you had the accident - you should have said "nah man, I'm drunk too, let's take a taxi".

There is nothing in the world you can say to pass the buck on this one. Sorry!

(Your ticket - your friend's insurance - you get the points/DUI, he gets the repair bill)

actually, they really can't do anything to force you to pay. according to the law, unless you physically took the your friend and drove his/her car without his/her permission, your friend is at fault. and the simple fact that your friend was in the car with you should make this case not even worthy for the courts.
if this is a moral/ethical thing, do what you think is right. personally, i wouldn't pay. what kind of idiot friend would offer a drunk/tipsy person the keys to his/her car?
