Say someone lives in Canada and was raped in the USA in NY. Can she file rape charges? And what is the statute of limitations on that?

this just happened last night...the guy took off with everything she had on her and she called a friend of ours who came and got her

Depends upon the age of the victim, whether the rape was statutory or forcible, If forcible what type of force was used and was a weapon was involved. She can file charges, but not in Canada, where the alleged crime took place. Why is she just now getting around to taking care of this?

Certainly she could file a rape charges in NY where the rape happen. What are you implying that she file the case in Canada, but the rape happen in NY, USA?

What statue of limitations on rape charges? There is no statue of limitation on rape case, unless you file it 20 years from now.

Yes, she can contact law enforcement (police or sheriff) in the city or county in which it happened and file a report. All such reports are passed on to the district attorney, who decides whether or not to file charges. The statute of limitations for rape cases are usually quite generous, probably at least 10-15 years. I'm not sure exactly what it is in NY.

She should have gone immediately to a hospital for a rape exam, rape crisis counseling and a police interview. Every minute that goes by what evidence there is becomes more degraded.

Call the cops, there is theft as well as rape. 7 years I believe on the statute. I have been wrong before.

If you didn't have a doctor check you out before you cleaned yourself, you will have an incredibly hard time proving rape; short of a full confession from the *sshole who did it.
