walking thru a residential area? I'm not sure what the law is here in my hometown , I'll call the cops tomorrow to find out for sure, but I do not own a car, and I sometimes walk a mile to the convenience store for a beer and drink it while walking home. Note: not on any commercial property, only when walking back home in residential areas. I do not see why it should be - after all, I am NOT driving, clearly, and am drinking only ONE beer while WALKING.......

I'm afraid I'll get an answer similar to yours hunny, but I simply don't see what the big deal is. I know that in Galveston, one can drink on the "Strand" street legally. I just don't understand why cops would bother me just for drinking a beer whilst walking home. O well, I'll find out tomorrow.....

Well Artman, I would not be intoxicated if I drink my usual ONE 24 oz. after-work beer....Like I said earlier, I just wouldn't get it (understand) if it were illegal........... Much more important things to worry about - like drinking and DRIVING....

In some places it is illegal to consume alcohol or have open containers in public and on public property. Some even go so far as to have laws that make it illegal to consume alcohol or be intoxicated on your or a friend's own private property while in view of the public. We are a nation of laws that are at times just dumb as dirt. Hope your town has some common sense. Maybe you should just buy a box of donuts and offer some to the cops if they do stop you.

I am not sure what the law in VA is now, but years ago when I lived there, it was illegal to drink beer from a can in public. You could pour it into a container such as a colored glass and it was all ok.
MD just passed a bunch of new laws and I don't know if it was a state law or a county law, I think it was Charles county that made public drinking illegal.

Laws re: public consumption of alcohol varies by city/town/county ordinance. If you cross through jurisdictions on your mile walk, the penalty could easily change. I would call your city or town hall, or county board of commissioners, if you're outside city limits, to find out the scoop. You might even find a listing in the municipal section of the phone book for Alcohol/Tobacco regulations.
Regulations for alcohol consumption are pretty tight all across the country, but it's right you should know what the penalty is for your area.

It depends on your local laws, in some cities is illegal to drink on the streets, in other is only illegal after a specific hour usually at night.
Besides that even if there is no law against drinking on the street, it ilegal to be intoxicated in the streets even if you are not driving.

I live in NY, we are not allowed to walk down the block drinking a beer. We can be issued a "beer ticket". Most people just put a brown bag over it!

It is not legal where I reside as any open alcohol container outside of a private residence or outside of the grounds of an establishment with a liquor license or permit is prohibited and the person could be arrested.

It is illegal in Gainesville, Florida and probably most places. That is why they give you a little brown bag. Take a plastic coke cup to the store with you and pour it into the cup.

I believe they call in public consumption, or some crap like that...better to go to you local pub, or wait until you get home. It's like open bottle...it's in the public street.

in my town that is charged as "public intoxication", a class 'c' misdemeanor (less than $500 fine if you haven't been convicted of it too many times). yes, you would get arrested for it here.
