I would like to have a small decorative fence installed to separate our lot from our neighbors. we have neighbors on either side of us... i have kids and it's mostly for their protection...like i said, i'd like to have a more decorative fence, not just something like hurricane fencing installed, maybe about 4ft high. Since one of my neighbors went on and removed all the shrubs separating the lots and replaced them with rose bushes it kinda ruined the natural border...i had intended to replant the bushes but without a fence i'm afraid they'll complain about the bushes up against the roses....we're new to the neighborhood too....so should i ask them if it's ok, i don't want any financial input on their behalf, just a little separation....what u think???

additional info...we've been here a few mons and recently had the property surveyed and marked with stakes and flags...but both neighbors removed the markers...i would hate to pay for another lot survey, its costly!!

I wouldn't ask them if you can build a fence, I would tell them you are building a fence and just wanted to let them know to be neighborly and all. You don't need their permission to build a fence on your property (assuming your not in a planned community that restricts fencing, etc) and you comply with the municipalities codes. If your not sure of your property line than have that verified and marked.

don't worry so much if your neighbors removed the wood stakes and flagging that marked your property corners. your actual survey monument that proves your property location should still be there. it is usually a 1inch iron pipe or rod that is set in the ground. it is illegal to remove those unless your survey is proven wrong court. good luck with the fence

You can inform your neighbor that you will be installing a fence to protect your children. If it is presentable, on your property, and doesn't block the sun from their yard, you should not have any problems. Your neighbor will probably thank you for containing your children.

Out of sincerity you could ask them. Most likely they will not have a problem with it. but it will still set well in there eyes. And when you build this fince call the city planner out to establish land boundries, and have the neighbors present to verify all of this so there is no dispute latter. Good luck and good fincing.

Legally no..... To be neighborly, ys. Also check with your municipality the see what Codes/restrictions the have. Also make sure fence is on YOUR property.
