pebblespro is repeating a common myth. There is NO law limiting what a former employer can tell a prospective employer about a former employee. The reason most employers won't say more than employment dates and job duties is fear of CIVIL lawsuits.

NEVER lie to a future employer about anything. The will eventually find out. Lying in the application process is grounds to fire you "for cause". That means you won't be eligible for unemployment benefits when they decide to get rid of you. You can bet they will 'discover' the lie at the time you are in the mmost trouble.

First, who puts inappropriate pictures on their cell phone. That is immature.

Do you know that you were fired for the lack in judgment of the picture on your phone?

You have to tell the truth or it will eventually catch up with you. Many people get hired after being fired once. But seriously grow up and remove the pictures from your phone.

i find it hard to believe that hr would fire you over here-se of a picture on a phone several months ago. i think there is more to this story.

but anyway, you don't lie, i guess you could tell the truth. the picture could be of a wife or a girlfriend, and you can say that. though it's hard to believe that you were fired for something like that.

Definetly be honest, cause if they have references from you and they call that place and they tell something different from what you said then, you are most certainly not going to get hired. So definetly go with the truth, may still not get hired, but you got a much much better chance. Good Luck.

There are two types of fired from the HR perspective. Fired: Not eligible for rehire and Fired: Eligible for rehire If you were fired for poor job performance, poor numbers, poor leadership, poor sales, or even poor attendance, you're considered eligible for rehire. If you were fired for theft, violation of company policy, or anything against your code of ethics, HR will block any attempt to be rehired.

What I did once was get a couple of different temporary jobs from which I got great references, to insulate me from the bad experience. Also I had friends who went to bat for me as references - I did have to ask someone to pretend to be a supervisor. But enough distance and its a non issue.

By law the company you worked for cannot disclose why you were fired they can merely ask the dates and times hired/let go and salary.. You can skim the truth and say that you and your boss didn't agree on some matters... Leave it at that.. Just don't bad mouth your boss.....

Under those circumstances, I'd sue the employer who fired me. That image on your cell phone could have been there outside of your control, and furthermore, it appears that it was his/her word against yours, and that type of allegation of harassment is commonly used by subordinates to retaliate against managers who take disciplinary actions against them.

However, no, you should not admit to being fired, just try to find a way to diplomatically explain that you left of your own accord. In most cases, the previous employer is not likely to attempt to black-ball you - you definitely WOULD have a case against them if they did.
