It wont.The courts dont care about the mistress as much as one spouse wants a divorce based on adultery against the other spouse. Naming or accussing the mistress wont have any affect on the outcome of the divorce so theres no real sense in bringing her into court except grandstanding in the courtroom

The one that didnt have a mistress will probably get more of the assets, get custody of the kids, and what not. And if youre a girl and hes a guy (Im assuming this since you said mistress) it will really benefit you by enforcing the image of the poor damsel being maurdered by the evil bas..rd.

Now as Im not one for steryotypes, hey. if that is the case, minus well show it. he gets what he deserves, which is nothing for causing you the pain of being cheated on.

most states today have a no fault divorce, and it really doesn't matter who did what to whom, but it is worth a try, if u are the injured spouse it may affect your settlement just depending on how the judge feels about infidelity.

Physical presence of the mistress may not be a 'biggie' and 'judgement' might depend, heavily, on judicial mindset and counsel's talent.
But for the same reasons matters such as frigidity on the other side and shared incompatibility might mitigate in favor of the errant husband.

What most people dont realize is if you dont get your lawyer to bring it up it most likely wont happen. This is between the lawyers and the judges and depending on what mood the judge is in that day they may not want to piss him off. If you can use it it will help matters dramaticly. Its called adultry and they really look down on it.
