ok i was on the freeway going at regualr 65 mph speed, i saw a high patrol car right behind me but he did not siren or turn his lights on, after 30 sec to a minute he turned his lights on and siren. there was nowhere for me to pull over because there was a merging lane to my right so i stayed in my lane and got off the freeway at the next exit because i felt it was the safest thing for me to do , wen i got off the freeway i pulled into a neighborhood. after i stopped he ordered me to get out of the car and cuffed me,he asked me why i was running from the cops and i said i was looking for a safe place to stop. he then started to search my car and found less than a gram of marijuana. after he wrote all the paperwork he told me that i was pulled over for tinted windows.. was the search legal??
can iget charged for "trying to run away" if its not listed on the citaiton? i did not try to elude him at all and did not put anyones life in danger.

how can i fight this

Pay the fine it will cost more for an attorney than it is worth.

First, get a lawyer. Second, no they can't charge you with evading & eluding since you did willingly pull over -- it may have taken you a bit too long to do, but that's a judgement call. The reason he stopped you seems a bit suspicious, especially after finding the pot in the car. Did you apply the window tint yourself, or was it installed as an after-market add-on, or a dealer option? Or was it installed in another state where the laws are different & it mneets those regulations still. A good, reputable shop can check to see if it meets your state's regulations/minimum standards. If you meet the standards for your locale you have a better shot at getting the pot charge dropped since there was no law violation -- which would make the search basically illegal.

1) Can't charge you now for running. You answered his question and he let it go. For future reference, put on your turn signal . That acknowleges you're trying to safely comply.

2) Stop may have been legal, possession was BS but equally maybe legal.

3) Find an attorney.

I'll answer you last question first: "how can I fight this?" - Hire a lawyer that specialises in these cases.
