The people I'm referring to don't do it at home or on the road, but do at parties, etc. They work, and support their own habits.

Parents are not responsible for them unless they are aiding and abetting... like if the parents are having a party and allowing underaged drinking, then its also intent to distribute.

The responsibility and penalties vary from state to state, however, the answer is YES.
1. If alcohol is served by the minor(s) at a function supervised or under the authority of an adult/legal guardian of a minor, under 21 but over 18, penalties are shared by both parties. The adult will carry the larger financial responsibility.
2. If the the server of spirits is over 21, then they will be solely responsible to the contributions of delinquency and subject to fine and or punishment for the in fraction and related infractions, damages, or causal events relating. (ouch).

word to the wise. It's not cool to say "my parents are cool with it", they won't be and legally they aren't.

Yes you would be, if the party is at your home it is your responsibility to make sure that you are not serving drinks to minors. Even if they bring the alcohol and they just drink it at your house and go out and get in an accident or a DUI you would be held responsible. Be safe and do not allow them to drink at your home, or if you do allow them to come and drink get their keys from them and lock them in your room until they are sober enough to drive home. Explain to them before they start drinking that this is what you are going to do. My best advice is to not let them come to the party in the first place because if the cops come due to a fight, or noise or anything else and they start questioning people and asking to see ID's and find out that there are a bunch of under age drinkers you will get charged with contributing to a minor or something like that. In the long run it so would not be worth it. Good luck and have a good time with a bunch of over 21 people.

In most cases I would say no the parents are not held responsible. But then there are some rare cases where the over 18 child but under 21 is not competent mentally (not mentally handicap either) to be making those kinds of decisions like my sister for instance. Not going to go into details but my mom is dealing with lots of issues with my over 18 sister and what she is being held responsible for.

I'm not 100% sure. I know that if you are over 18 you are an adult, but I think it get tricky because if the teenager still lives with their parents that's different, just like in college, even if you are moved out of your parents house, if they are still claiming you on their taxes, then you alone couldn't get financial aid if your parents make too much.

This may be different and like others have said, it depends where they are drinking. It's not possible for parents to know where their teenager is 24/7 and they could be lying anyways so I think the teen will get the heat, not their parents.

Kids 18 and over are considered "legal adults" - the parents can only be held responsible if they're providing or selling the alcohol... in other words, aiding and abetting or contributing

Children over 18 are resposible for what they do. If the Parents provide a place or otherwise facilitate drinking they are contributing to delinquecy of minors. I believe it's through either act or omission that you can be charged.

How do they get their alcohol, that is the question?? I don't know if the parents could be responsible for it if it was not on their property, but, if they are buying it, for them and they are found out, they will be in trouble with johnny law. If it is consumed at a minors home and their parents are there, more trouble.

Nope. If you are 18, you're an adult, and fully capable of going to jail or paying a fine yourself. Parents have no legal resposibility, provided they were not hosting the party.

Nope. The kid is an adult in the eyes of the law, but not adult enough to drink, in the eyes of the law. The kid gets in trouble, not the parent.
