Unfortunately, Yes they can. It is not one of the protected classes (Race, Color, Religion, Pregnancy, Sex, National Origin, Age, Disability, Veteran Status and in some states, sexual orientation). However, if you're upfront about it and explain that it was a long time ago (in person) then you'll have a much better change of getting them to rent to you.

Yes, not all discrimination is illegal. They can also discriminate against smokers, deadbeats, slobs, jerks, and anyone who comes with a poor reference, among other things. Agree that the best choice might be an honest discussion, up front.

Yes, they can. Choosing not to rent to someone because they were convicted of a felony is in a totally different league than not renting to someone because they are black or because they are Muslim and is not discrimination. You were convicted of a felony as a direct result of your own choice to violate the law. In contrast, you cannot choose if you are black, white, asian, hispanic, etc. and while you can choose if you are Muslim, Christian, Jewish, etc., none of these choices violate the law.

Landlords have the right to refuse to rent to felons. Its not discrimination, its good business. nobody wants a crook in their property. lawlessness is not listed on the constitution as one of the things it is illegal to " discriminate" against.

If they are doing a background check that is what they are looking for. Before you apply make sure they are not going to check for this, otherwise they will use it to decline your application.
