Court is really on?

The job of the supreme court is to understand the constitution and make legal decisions to see if laws violate their intepretation of it.

Some feel the constitution is a living and breathing document and it should allow for liberal interpretation. Others like myself view this as a contract that is meant to be followed based on the wording of the document, not some other outside forces.

For example, there was a decision recently by the supreme court that used "international law" for a case based in the USA. International law has nothing to do with how our country operates. Therefore this was Judicial Activism.

Same with the ruling of emminent domain. How can government "take" property and give it to another? Reason this was done is to boost tax revenue. That is communism, but it has happened, I believe, in Rhode Island or Vermont. The Ohio supreme court ruled that government cannot take an individuals property and give it to a corporation.

So hopefully they are on the side of the people. But it depends on how liberal the judge's interpretation of the constitution is.

In theory they are supposed to be impartial, which is why they cannot be removed from office based on a presidents whim, and their salaries cannot be lowered. Say for instance a president nominates a justice for confirmation based on his/her views on abortion. Once that nominee is confirmed, he/she could do an about face on their stance and the president would have absolutely no recourse whatsoever.

However in today's political climate the justices who are nominated by the sitting president, are hand picked in order to ensure that the verdicts are keyed to the ruling parties platform. This is true of almost all nominations. Long gone are the days of the supreme court being non-partisan.

Today's court is definitely on the side of the conservatives. But it also seems to be, for many issues, on the side of the Constitution. I don't LIKE some of their recent decisions, but I do UNDERSTAND them from a strict constructionist standpoint.

Activist Judge: Any jurist who interprets the law in a way that doesn't benefit you.

They are "Majority GOP", which is different than conservative. There was a time when the SC was above partisan politics, but those days have passed.

Eisenhower called his Chief Justice, Warren, "the biggest damn fool mistake I ever made". Warren became more and more liberal as he presided over the court.

Today:
O'Connor said she did not want to leave the court unless a Republican was elected in '04. Nice!

Thankfully with the appointment of two constructionist judges recently they're heading back to the side of the American people and the Constitution.

Traditional Americans. People who believe marriage is between one man and one woman. People who believe that a baby baby who can live outside the womb should not be murdered. People who don't buy into that separation of church and state garbage. If we have on our money and in our pledge of course it should be said in public schools...

Ideally, they should follow only the Constitution, and not choose sides.

But because they are only human, they can sway either direction.

As for now, they are leaning more to the right.

well lets see the maddled in a National election and gave the nod to George W Bush and ordered all ballots that could have been recounted destroyed

No ones' side. That's the point. If they have a side, and it shows in their rulings, remove them.
