Our order is for every other weekend here in nyc but his is relocating VA and has not been working since Feb. 07. He wants to adjust the order to change the time. He is not reliable or stable. He moves from woman to woman and dragging my children through it and is not paying his child support at all he owes close to $15,000.

I DON'T HAVE A LAWYER. I NEVER MIXED HIM NOT PAYING CS WITH HIM SEEING THE CHILDREN. I AM THE ONE THAT STRESSED HIM TO GET THE ORDER SO IT WOULDN'T BE WHEN HE FELT LIKE IT, BUT I HAVE A PROBLEM WITH HIS LIFE STYLE AND THAT IS WHAT IS MAKING ME REALLY LEAN TOWARD TELLING THE JUDGE IF HE WANTS TO SEE THE CHILDREN NOW FROM VA IT WOULD HAVE TO BE SUPERVISED BECAUSE THE CHILDREN SHOULD NOT HAVE TO BE PUT INTO SITUATIONS THEY NEED NOT KNOW ABOUT. HE DOESN'T HAVING ANY MONEY TO TAKE CARE OF THEM WHEN HE HAS THEM DUE TO HIM NOT WORKING. WHEN I GOT MY CHILDREN BACK THIS PASS MONDAY AND I ASKED HOW MY SEVEN YR OLD GOT A BRUISE ON THE SIDE OF HIS FACE AND WHY HIS EAR WAS HURTING, THE FATHERS RESPONE WAS HE'S A BOY, HE'S FINE. YET MY SON AND MY 10 YR OLD DAUGHTER TOLD ME THEIR FATHER PUSHED HIS HEAD AND IT HIT INTO THE DOOR AND HE DIDN'T SAY SORRY IF IT WAS AN ACCIDENT AND THIS WAS AFTER HE GOT TWO SPANKINGS ONE BECAUSE HE WANTED TO GO HOME.

Unfortunately, this situation will most likely put you back in court. Speak to your attorney before you do anything. If you attempt to deny visitation on your own your ex could have you arrested.
Also get your attorney to help you through the process of having his wages garnished so that you start receiving your cs.
Most importantly before you do anything ask yourself if you are doing it for the best interest of your child. The children are the ones who get drug through the nastiness of a divorce and we have to be so aware and so careful to make the road for them as easy as possible because they are not the ones who asked for the situation. . .I know ;)

Since he is not current in his child support you can deny him visitation. Also you should have taken your son to a hospital for his father abusing him. Now it is your word, and your child's word, against the father. Does he have the money to take you to court if not then don't worry about it. I wouldn't send the children back unless they ask to go back.

I would get a lawyer...espically with him being out of state. And if he owes that much money I would take him to court. I live in KY and I know that custody and child support have nothign to do with each other. My little girls dad doesn't pay child support but I still have to let him have her, which isn't far.

No you can't deny visitation on your own. The fact that he owes back support doesn't enter into it. Support is NOT payment for visitation, they do not go hand in hand. You need to discuss his lifestyle with your lawyer and see what the court says.

You should take him to court to get your child support, and no you cannot just deni him visitation, don't voluntarily modify the visitation, tell him if he wants it changed he will have to take it to court. But if you won't let him see the kids, no matter what hes done, it will look bad on you no matter if he's a worthless parent or not. Just remember he is their dad.

If he is moving out of state, then the responsibility will be his to get his children to him for visitation. If he owes you 15,000.00 then I doubt if he can afford that! Plus if he is that far in arrears then you need to take him back to court!!

Through the courts. Talk to your lawyer.
Also, contact child's advocacy - and start garnishing his wages for back support.

Wow,..... get a lawyer and throw his****** in jail but then you have no support, what good are these laws if they are not enforced????? What a dead beat ****** he is, I feel sorry for you.
