first of all you have to understand that it happened in Canada, they have very different laws and they are quite fond of seagulls there.

Second, you have to realize that he did intentionally throw the ball at the bird. Winfield was trying to scare the bird off because it had landed in the field.He assumed the bird would see the ball and fly away before the ball hit it. He didn't realize the bird was hurt and couldn't fly away.

I think the combination of the fact that the throw was intentional (although not intended to harm the bird) and the fact that Canadian laws are different than US laws combined to cause his arrest.

Once he explained himself the charges were dropped, but I think there was a misunderstanding where the cops thought he was actually trying to hurt the bird for fun, which is why they arrested him.

He was arrested because the police originally believed that he had been trying to purposely kill the bird, and so he was charged with animal cruelty.

The charges were eventually dropped after Winfield argued his innocence.

It was an accident & it was unfortunate. They acted as if he did it on purpose & they overreacted.
