If the company pays for and owns the clothing, then they have a right to dictate the rules.

Many companies do not allow their employees to smoke at anytime. On or off the job. There are no laws prohibiting discrimination against smoking. In today's world where employees are complaining about losing health care benefits, these companies are saying, OK, we'll team up with you to keep health insurance costs down. We'll shop around for an insurance carrier that will give us good rates for a work force that doesn't smoke. And you employees do your part by not smoking. Deal?
It's perfectly legal and many companies are instituting the rule after the fact and giving smokers the time and help that they need to kick the habit. And if they are supplying the work clothes, they can chose to have them smell any way that they chose. And of course the employee has a right to find an employer that will let him smoke in any clothes that he wishes. And buy his own medical insurance.

could be however if it were the case smoker or not i would never work for a corporation that made those kinda rules.
technically they can say you can not smoke in there uniform it is there's your only using it . secondly that deters smoking and will make what they pay in health insurance less. in addition to this if that was the case i think you would find that they have a no smoking policy on there property as well.
There are NO RIGHTS for smokers currently. As a smoker i feel that it is dictator tactics.

When I used to work in uniform, my manager advised me not to smoke anywhere the public could see, i.e don't just pop outside the shop, go around the back to have a ciggie because it is against company policy for employees to be seen smoking in uniform. This was about 5 years ago.

Makes sense to me. Cigarette smoke permeates everything and the uniform would end up smelling like a stale ashtray. Smokers lose their sense of smell so they would not know this.
Also, and perhaps more importantly, the company does not want to project the image of employees in uniform standing around smoking their brains out.

I am guessing that it can be true...especially if you are on the clock (even on a break).
There are companies that have policies of what you can and can not do even off the clock in uniform. For example...have you ever seen a Pepsi delivery person (in uniform) drinking a Coke???

i think this may be up to the company boss.
like smoking in company cars, some say no and some say yes .... this is on only one person driving the vehicle.
this smoking ban is a bit extreme

It may be true for some jobs but I doubt its true for most. Soldiers smoke every chance they get.
People who work at Waffle House smoke on their breaks, too.
