We were canoeing and banked to have a cook out. We grilled had some drinks and then cleaned up all wrappers and baggies except for one bottle. Left the bank then we were called to the other side by some "Conservation Police" that had just come out of the trees. An air boat pulled up and they asked us what we were up to. They then proceeded to run my record on their laptop.

While questioning me they asked where my hot dog wrappers were, where my mikes hard bottle was, were our daquiri bottle was, where the cheese wrappers were, and the plastic from the mini grill. I had them all but one bottle and I received a $75 ticket or I can go back (1.5 hours) and goto court. Is there any way to fight this? it seems like they watched us the entire time we ate with binoculars (around their necks) - kind of creepy

No; watching and protecting environment is their job. Conservation Officers have more authority than State Police Officers and they can issue tickets for any infraction of the law on land or on the water.

It is highly doubtful you could win in Court, but you have the legal right to do so if you chose. On thing you may want to find out first is what the Court Fees would be if you challenge the ticket and lose. Court Fees vary, but it would not be unusual for you $75 ticket to turn into $75 ticket and $125-$200 in Court Fees, plus having to take time off work for the initial Pleading and subsequent Court date(s)...usually the officer that wrote the ticket are allowed to miss the first Court date if their schedule does not permit them to be there and the matter is continued to a later date. It could then again be Continued if the Court does not have time to hear the case because there are more serious cases on the docket.

This sounds real wierd. The whole time watching u is disgusting. Sorry i cannot give u any tips regarding a 'fight' in the court. But i real envy u - the way u cleaned up the whole mess - the country i come from (dont want u mention) - i bet not one person would do that.

I'm sure you could go to court and fight it. But did you leave a bottle behind or not? Yes I agree that watching you with binoculars is really low, but don't officers use speed guns to catch us speeding? I'd pay the fine.

I bet you are the type who throws trash out your car window. "OR" You made an honest mistake. It also sounds as if the Police have very little to do in that area. (A Policeman goes to college just to watch some one forget some trash) I say "Go to court" and fight it. If it was an honest mistake you should get off with a warning. Good luck.

That's very creepy. I think I would try to fight it. It's not like you purposefully littered. It was just an oversight. Even the people who ticketed you would have to admit that you tried to clean up after yourself.

Thanks for cleaning up after yourselves. Too many people just leave it trashed. I doubt you can beat the ticket but I might try to fight it. You never know, a judge might be on your side for trying to do the right thing.
