That is a problem. Make it known to your insurance company get them involved. The car has to be restored to its former condition or you will now accept it back from the body shop. DO NOT take the MB to a common body shop the at fault insurance company uses. Find out what body shop all the high end cars go to. And make sure the insurance company at fault provides a rent car of the same quality your used to. Not a Hyundai Elantra. I have seen very good repair and I have seen cars i would not want to drive come out of body shops.

That is your insurance companies decision to make. They will total a car based upon the accessed value of the car. Since the accident was not your fault I would suggest seeking any tangible loss from the person that was at fault. Since it was an 07 you can see about a buy out, or just trade or sell it in right after it is fixed.

Everything depends on how much damage was done to the MB. If the cost of repairs exceeds the value of the car, then they would replace it. With it being a 07 chances are good that the damage will be repaired. Good luck with this one, I fear that you will not get the satisfaction that you want.

Your insurance company has the final word in this matter. If they decide to repair the car your only option is to take the check then sell the car as is for parts then replace it. The purpose of insurance is to make you "whole" in their eyes repairing the car is the feasable thing to do.
