you defend yourself in court, get a lawyer and prove you did not do it

Well if you are being served with papers to appear in court, then you have to appear in court, or several things can happen.

If the papers are for a criminal offence, then the Judge could issue an arrest warrant for your arrest. Then you will have the charge of Failure to Appear added on.

If the papers are for small claims, i.e. being sued for damages or what not, then the judge can issue a default judgement against you if you do not show up. Which means you are guilty and are liable to pay the damages.

The best thing to do is to gather your proof that you did nothing. You could even hire a lawyer to help you. And if it is prooven that you didn't do it, you might have recourse to sue.

Which ever the case may be, you do need to show up, so nothing more can happen.

HA! I've had this happen more than once. I use to live behind a Crazy Vietnamese lady and her Stupid American husband with there No talk English kids. They where always trying to take me to court for money and stuff. Unless they can prove without a DOUBT that your the one who did something. Don't worry. I know it's scary at first. My first time in court for something I didn't do was HORRIBLE. But after the 2nd, 3rd, 4th time...it gets easier.

If served a summons to appear that is what you do. .

Tell the truth and get representation if this is serious. You did not mention if this is is small claims or Superior Court.

If a fabrication you may have a counter claim.

You have to defend it. Being served means it's going to court, so best consult a lawyer.
