I do work and am paying ALL the bills. He has stopped working and is now faking a knee injury to avoid paying. (he's an electrician) I have filed for Child support and spousal support. I want to know if he will be able to take the house from me. I understood it that when he left by abandoning us he gave up all of his property. Is that correct???

Try this website http://www.vsb.org/publications/brochure/divorce.html

It is a pamphlet giving simple rules as to what is legal for divorced grounds in Virginia.

The wife needs to file for divorce based on abandonment. Get a lawyer and the court will go after him to give you money to take care of the children.

Immediately file for a divorce under abandonment. Have him pay child support and alimony.

If you don't have money to pay for the divorce go to the supreme court matrimonial court office and ask for a divorce package. This package is free of charge and you can waive the fee. Good luck.

Virginia is a common law state you will have to ask an attorney but if he owns property it will most likely be given to you because you have kids and i would go to the child support division and get a child support order.A divorce in Virginia also takes up to a year. And If he is in the military his command will hammer his tail.

In Louisiana nothing can be done until you file for divorce. There is no law here stating that he has to support you when you are married. There is free legal aid for people in your position. Call your local Welfare office and they can tell you who to contact in your state. Good Luck.

I don't know the laws in Virginia. Personally the penalty I would give him would be castration but I guess that would not be going the legal route would it?
