Even though I have filed an Eviction (Austin, Texas) can I still post a for Rent Sign in the yard? We go to court on the 2nd of July. Tenant is still there.
This lady has always paid her rent, but keep slpping in dogs. First it was a pit bull several months ago & now it is 3 little dogs & before she moved in, I spend $40,000 to completely re-model the place place.

Everyone seems to be answering the question "can I show the apartment" unless I'm mistaken you're just asking if you can post a sign. If that's the question, then I don't see why you wouldn't be able to. It's your property you should be able to advertise on it if you want to.

If you are asking about showing the place, I'm not sure if you'd want to bother. You're going to court in a few days so you'll know whats going on then. In the mean time, I don't think she's too happy about being evicted. I don't know what type of person she is but if it was me I'd make it available if the lease said I had to but I would not clean the place and make it all kinds of messy.

I would wait to she has been officially removed from the place before you try to show it

next eviction for other then non-payment of rent, is not always as sure win, plus the court has certain requirements of notice to cure and notice to cease before commencing an eviction for non-payment maybe Texas is different

The best thing for this is to call or local Magistrates office ,they answer questions like this on a daily basis, i could give you what i do believe is the right answer, but i would prefer you have absolute fact, just call them they are glad to help

It's your premise; you can advertise to show the dwelling. However, if your lease states that you cannot show the apartment while the tenant is occupying, then you have to wait until they vacate. Normal cases, you just have to notify them that you are going to have showings on a certain time and date.

FIRST: contact the sheriff and ask
2nd: put an add on the paper
3rd: do you have pics of the property? you can show it online with pics
4th:review your contract and, lastly
5th: local book store, buy a TEXAS landlord book (nolo is a good editorial)

If she is officially evicted, you should be able to put a rent sign. If she is not. I am pretty sure you can't.
