i know my myspace has been viewed by others and tom has told me so he is the moderater..how can someone use messages i didnt write agaisnt me they get into my myspace and read and post messages..so how can some one use it agent me..especially when someone gets into it or creates one in my name..any help appreciated

anything you say, do or write can be used against you in court.

if its someone else posing as you. You need to get ip addresses to prove its not you. maybe toms got some info on those.

also comparing composition styles could help if you have a good lawyer.

you need to clarify some of your question.
its kind of confusing.

They make a myspace under your name, then frame you.
If someone does that though, it'd be easy to get out. Because in the first place you have YOUR OWN ORIGINAL MYSPACE. You could argue and say "Why would I make another myspace when I already have one?"


OH BTW MIGHT I ADD A VERY IMPORTANT DETAIL.
When you view your own blog, on the left it shows the date you joined/created myspace.

IN THAT CASE! The person that made the myspace to frame you would automatically lose the case. Because if they were to go into the myspace that they made, it would show a recent date.

There are a huge number of ways to verify your identity online. Should someone attempt to use your information against you in court that information has to be verified using accepted practices for verification. If the information actually came from a computer you have "ownership" or "physical access" to, you could be in quite a lot of trouble.

Short answer, yes they can use messages you create against you in a court of law.

I'm not sure of the actual legal answer... but I have some things that you can keep in mind that might help you feel better... number one, they know where someone was when they set up an account (like not in your house)... the know the e-mail address used to sign up for it, and therefore they know who has accessed that account and from where (again, probably not your house)... and in my own personal experience, cops (and lawyers) will very seldom use anything from online in a case against someone. although thats not universal...

You can take your lap top to court and maybe show them just how easy it is to make a myspace profile. Make a profile of the judge or lawyer for example in front of them..
