The parents, and wife & chilren of him can sue for sure but not you unless you two were living together like an incestuous gay couple.
Besides suing a drug dealer might be dangerous; better call the police over him and let them do all the legal stuff; they will arrest him for the drug so you wont have to spend money on a sue that you might not win.

You can't sue someone in civil court when the cause was illegal to begin with. Prove your cousin needed to smoke for medical reasons and you might have a case.
More than likely the marijuana was laced.

You can not overdose on pot no way no how. I smoke everyday all day long and a lot and Im fine there is no way to overdose on it maybe he just smoked some really good stuff in that case whats the guys name? lol kidding. No you cant sue anyone for that you cant even prove who he got it from anyways.

Regardless of who sold it to him, he's the one who took the overdose.
That's like suing a pharmacist. The pharmacist didn't force you to take extra, you chose to.
Beside,s you can't sue for illegal goods anyway. Unless its legal in your state, your cousin broke the law by buying it. You can turn in the guy who sold it, but you can't sue him.

If indeed it is found that your cousin overdosed on marijuana then you would have to show that the guy that sold it to him was the proximate cause of his death.
For instance, but for you cousin smoking the weed he wouldn't have overdosed. Also, but for the guy selling the weed to him he wouldn't have overdosed. Who is more culpable though? Since it is not forseeable that someone would overdose on weed then the guy would not be liable. Further, even it were forseeable that your cousin would overdose on the weed, he contributed to his own overdose by smoking it and the guy that sold it to him would not be liable especially since marijuana is illegal. That's why it's illegal because of the harmful effects.

No you can't because its personal choice to use or not The seller didn't enforce especially in this case is illegal stuff, unlike MacDonald (under the law to make people fat so the society can bring them to court). But you can prosecute him if you have evidence that he sell marijuana but he will probably get out free after six months unless you hire a damn good lawyer maybe you can put him behind bars longer.

Your brother's the one who might sue--you do not have "standing" to sue for an injury to another person unless you are married to that person or that person is your child.
Your brother's lawsuit would be dismissed under the rule "ex turpi causa non oritur actio," you can't sue for being bad.
You want to help your brother? Good. Take him to an N. A, meeting. You might save his life.
