ok so the smoking ban is in place from july 1st thats the law fine. but where i work we are being told by the management anybody caught smoking will be fined £50. i can understand the police having the righ to fine smokers breaking the law but does this right extend to your boss?
the money wont go to help law enforcement but line the pockets of my boss is he acting with in the law? this is not a wind up us members of staff were informed of the policy today

wonderwall confront my boss thats why i'm asking this question i cant tear him down a peg our two without knowing that i can do legally. if the government allows him to do this fair enough if he is breaking any law then i can complain unless i ask i'll never know. but thanks for you answer i'll be sure to make totally sure you wont get the ten points

Your company are not allowed by law to interfere with your wages, if they do they have dropped themselves right in it like my employers did and it cost them £1,400 in compensation.

Your company cannot issue a fine on you and demand you pay a fine, they have no right other than to discipline you.

Your employer is ensuring that he is covering himself by setting rules about smoking in the workplace. The employer can be fined for not making sure the staff obey the law, so yes he is well within his rights. I can't see what the staff are complaining about as they know the new law is starting so surely they are not planning to break the law so it doesn't matter how high the fine is.

no, your boss cannot fine you, only the cops. He could report you to the cops but can't do more himself, except fire you as you will be breaking various regulations. He does , however have to provide you with an outdoor smoking area, this will be fun in the winter. Scotland has been 'non smoking' for 12 months now and it is a minefield of mis-information. It is also a good opportunity for the anti-smoking guys to turn very self-righteous. Beware !

I know this is for the UK but think about it, you are at a private Co.It is in their best interests if you don't smoke because you will not only take less bathroom breaks( to grab a smoke), you will be off with less health problems. With no smokeing in the building, even the people that don't smoke will have less problems because they are not breathing your 2nd hand smoke.Since your time at work is being paid for, it actually belongs to them and I woulld say it is legal.

I suppose it's better than the sack. That's what we are threatened with unless we go outside the gates. As for your boss having a right to do this , i would very much doubt it. Oh and if he does try this , why don't you report him. He is basically allowing you to smoke ( never mind the £50) and that is illegal.

The company may be fined if people are caught smoking but I don't think it's legal for your boss to fine you.

Well he may not have the authority to actually fine you £50, but he will have the authority to discipline you or even sack you if you break the company's non smoking policy.

He needs to offer some incentive because if you get caught smoking in his work place he will get fined as well as you.

No, I dont they can actually fine you, but they can probably report you so as you do get fined.
