Man in OH won $4,800 on a alienation of affection complaint when his ex-wife was caught eating pizza with her paramour. Alienation of Affection usually has little to do with sex but with any public affection - like kissing, holding hands. Apparently, that was the first time in 40+ years that a case was won using alienation of affection as a defense.

I'm not sure what the legal term is, but you'd be smart to obtain a lawyer over this matter.

The idea of what constitutes sexual deprivation during marraige differs between judges & court rooms. Some may say that only having sex once a week is sexual deprivation, while others may be happy with that & say that once a month is sexual deprivation. Some courts will not take you seriously unless it is along the lines of once a year or no sex in multiple years. You will also have to show proof that you tried to make the marraige work, both emotionally & sexually. They will ask if you have tried counselling & the like. A lot of times if a man tries to divorce a woman claiming this reason it will make him appear like a jerk, even if his claims are more than valid.

It's better if you just say that the marraige didn't work out due to incompatibility. It'll save a lot of trouble in the long run.

They are usually not that explicit. They just refer to the basis for divorce as incompatibility.
