We still don't know what went on in the "energy policy conference" in the White house in early 2001, but the results are painfully clear. The records of that conference are the property of the American people, but they won't let us see them. Now Cheney claims that he isn't a part of the Executive branch of the government. Is he above the law?

No Official of the government, regardless of which Branch he/she is a part of is above the Law. Article 2, Section 1 states that (in short) the Executive powers will be vested in the President and the Vice- President, therefore it is safe to say that Vice President Cheney is a part of the Executive Branch.

I applaud the House and Senate for reaching agreement on a comprehensive energy bill. America will be safer and stronger with a national energy policy that will help keep the lights on, the furnaces lit, and the factories running. A good energy bill is part of my six-point economic plan to create the conditions for job creation and a sustained recovery. It isn't about being above the law. That's like accusing you of flouting our laws because you won't let us deport you as an illegal immigrant.

"What!" you argue, "I'm not an illegal alien and don't have to answer your law!"

And they answer, "Is he above the law? Should she not be deported? Especially now that she shows she does not respect our laws?"

It would be silly.

Check what position the Vice President actually holds. If he isn't part of the Executive Branch, then he's right.

If he is, it should be easy to prove. Using rhetoric like "Is he above the law?" is contemptible and unjust.

no one is above the law. i am sure that if you filed suit in federal court under the freedom of information act, and the documents you want to see are not classified, you will get to see these documents. but this smacks of more hypocrisy from the left since Hilary ran the health care conferences behind closed doors, and we have yet to know what went on there.
