An apple tree was situated in the hedge between my house and my neighbours, it was difficult to say who it belonged to. New people have moved in and chopped down the tree, it was small and branches hung into our garden giving us apples. We were out one day and came home to find branches on our lawn and a note saying 'have chopped down tree, branch fell in your garden' is this acceptable? They could have trimmed the hedge back on their side of the hedge and left the trunk in the hedge and branches on our side.

It was rude to say the least not to talk to you before cutting the tree down. They lack diplomatic tact, for sure. This neighbor sounds like possible future trouble. Proceed with caution.

What is done is done. Unless you want to go to the expense of having the property surveyed and then try to take them to court or something there is not much to be done. The tree is already gone. However you might try to come to an agreement with the neighbor that from here on, anything to do with that hedge needs to be discussed before being altered. Is there room to plant a new apple tree on your side of the hedge?

I would say no. They had no right to remove the tree without asking who the tree belonged to. They should have had their property surveyed to see if the tree was theirs. If the trunk of the tree was on their land then they had the right to cut it down. If the trunk was on your side of the prop line then they had no right to. If it was directly 50/50 on the property line then it is a toss up. As far as your garden they are respondsible for the damage. If the branch was gone they trespassed

That was so incredibly rude. My only suggestion is that if you don't want this sort of thing to happen again, then you need to let them know that you didn't appreciate them cutting down the tree especially since there is a boundary question. If you let them walk on you this time then who's to say what they will do next. Just recently I had to stop a lawn service hired by the owners of a neighboring rental property from cutting down my trumpet vine because he was told to clear the fence because they were going to list the house for sale. I told the guy that the fence is mine and since the vine trunk is directly on the fence line then it is mine as well and he agreed and promptly called the person who hired him. Needless to say the vine is still on my fence.

if they knew their property boundary , they had the right to cut it down without discussing anything with you . check with the city .they can tell you where your property line ends.
