I was in Spencer's, there was a "penis pop", so to speak, on the counter where you pay. I was a few dollars short of a discount, so I thought what the hell. And since I had absolutely no use for it, I gave it to my friend.

I gave it to her outside the mall, by a large group of kids congregating. Naturally, "police officers" came up in order to break up the crowd, and when they saw the lolli-pop, one demanded her to hand it over, and threw it in the garbage can.

Did he have the right to do that? He claims it's because it is not family friendly, and we were outside on public property (Funny, though, because when we smoke, he calls it private property). However, they sell it inside the "family friendly" mall.

Lots of stores in the mall carry items that are not "family friendly" that are meant to be used in the privacy of your own domain (home, car, etc). Music with objectionable lyrics, guides to improving your sex life, sexy underwear, R rated (and stronger) DVDs, and penis pops are just a few examples.

Now as to the officer that threw away your lollipop; it is his job to maintain order and decency. If he is mall security, then he might be overstepping his bounds a little; but he also could have ejected you from the mall and banned you for life.

One more thing, the mall is private property that is open to the public. A real estate developer built the mall and leases spaces to the stores. The private property normally ends at the far side of the parking lot.

Was it a security guard or a police officer?

I really think this should be brought to the attention of Mall management if the security guards discarded your recently purchased merchandise.

If I were you, I would file a written complaint with the Mall.

Since they obviously have stores which sell this kind of product, there is no reasonable explanation for the security guard to have destroyed your property for the sake of "family friendly" atmosphere.

Your rights have been violated, because there is nothing in the law's about "family friendly" candy. If this were the case, candy cigarettes would be illegal.
