Legally, yes. Practically, if no one saw the offense, who told the Police you did it? If the offense is eligible for a citation, as opposed to arrest, they usually don't issue one unless the Officer witnesses the offense.

Yes, but you can dispute it, it's your word against the person filing the citation. You will just have to be the more convincing party
