before we approved the people moving in and before we signed the lease. Thats the first problem. They told us they would mail the 3months paid rent and deposit to us on the 14th. No checks today 6-29 so I called. the accountant said its been busy the pass week and theres a new computer system, the check are cut but she hadnt mailed them. She said they'll go out monday july 2nd. Is this legal for them to hold money that isn't theres, when people are already living in our house since 6-12. It's almost been 1 month?

When using an agent to rent your house, you are usually giving them the right to rent it to anyone they find acceptable, without your approval. You are paying them for their experience in finding suitable renters. If your contract with them says you have the right of approval, then they screwed up there.

They have a pretty pathetic excuse for why you don't have your money. When I was doing work for a property management company, the checks always went out by the tenth (rent due by the fifth). If you are still local, call them and tell them you will swing by and pick up the checks. If they don't have them, you know you are being lied to, and it is time to get a new agent asap.

First of all, check your contract to make sure it doesn't say anything about allowing the tenants to move in on a specific date. It is against the law for the realtor to give your authorization to let the tenants move in when you haven't signed anything, and you were not notified in advance. Contact the realtor and if they can't give you a straight answer, threaten with a lawyer. If they have your money and they're holding it, go to their office and demand the check immediately. CHECK YOUR CONTRACT FIRST. If you go down there and get the money before checking, there could be something in the contract that says your authorization is implied when you sign for the check.

It will depend alot on what the contract between you and the realistate compainy saids. But I don't think I would use them again to be honest to let someone move in before you met and made out a lease with them just isn't right.

Sounds like they hang on to it to get the interest...check your contract and see if it mentions that...

I assume your not there only clients...
most prop. mgmt places operate on 30 days, not over-night service.......
you didnt get a time schedule, just assumed you were 1st in line........

i think you should start shopping around for another agent sounds like yours is a crook . good luck.
