My mom is terminally ill. My sister who is 24 years old gives her a difficult time and comes and goes as she pleases. My sister is NOT on the lease. When I took my mom to the police station to see what they can do, they said nothing. The officer told her she would have to file an eviction on her. That makes no sense since she is not on the lease. The officer said it dont make a difference. They live in a southwest suburb of Chicago. Anybody been in this situation? How can she get her out???

Sadly, the police are right.

I had a very simular situation a few years ago, except it was a boy. About the same age and he made everything AWFUL for everyone. I bought him a one way bus ticket to his fathers house, drove him to the bus station (he had no idea yet) booted his sorry butt out of the car and told him to get on the bus.

This worked rather well.

even though shes not on the lease she is still been a resident longer than 30 days. u must serve her with 30 days notice to vacate (you cannot do this a 3rd party can though) after 30 days, bring a copy of the paper and file a court eviction. It will cost you about 45.00 to file this. then a judge will rule and have them evicted. usually atkes about 30days for whole process to go through. after you have a court ordered eviction, you can contact the sheriiffs department come, remove her and her belongings and have the locks changed so she cannot come in the house.

The cop gave her the correct answer. Whether she's on the lease or not, she has established it as her residence and the only way that that can be terminated is to proceed with a formal eviction through the courts.

If she's lived there long enough to establish residency, then she's considered a tenant even though she isn't paying rent or on the lease. By allowing her to live there for more than what would be considered a short "visit" (usually two weeks - that may even be spelled out in the lease - it is for my tenants) your mom has essentially sub-let part of her place to your sister without charging her rent.

Check with your mom's landlord. They may be able (and more willing) to help than the police.

If your sister can show residency in the apartment for 3 months then she has to be evicted. ( that is the law) There are other ways to get rid of unwanted house guests. The other option is to get a big guy to persuade her to move out. Or just wait until she is gone and change the locks. If you are in a rental you will have to notify the owner about changing the locks.
