Yes, historically women have been the primary care givers especially for small children and the courts have followed with that reasoning. That being said, I think the times are changing for men. I have noticed that there are more states that are balanced with their judgments both with financial obligations and custody. There are still some areas of the county that fall behind (SC for one). I think the courts are starting to see that children benefit from having considerable contact with both parents. Yeah for the kids!

We live in a misogynist society. there is the rule that women are the care givers, and dad's only provide money. mom was at home, cleaning and changing diapers, whie dad had a life, and a place in society.
so in the case of divorce the law still acts out this sexist notion. give the kids to mom, and dad has to continue being the financial provider. all that money doesn't translate into " he get the kids because i spent so much money on them"
mostly, they don't argue if a dad can care for his kids, instead inforce the rule that he shouldn't.
it is the misogyny some guys put out there coming back to get you in the end.

Yes but.... The system is defiantly moving toward joint physical custody. They are finally figuring out that both parents participating regularly is best for children.

yes but the realanswer goes back to the beginning of time. The vast majority of people were raised by their mother while dad supported the family and thus the courts award custody more to mothers barring any unfit reason because they are better at raising kids than dad.Not that dads do a bad job,its more naturlistic for mothers

I must live in the only town in the USA where people are still living like cavemen. Men that beat their wives, scare people to get what they want, can't do anything to take care of their selves or a child and get joint custody.

Yes.. I thought that was pretty well known. Alot of courts tend to lean towards mothers since they actually gave birth to the kid. I think its harder for a mother to walk away than a father to walk away. I know it happens though because my "mother in law" walked out on my husband and his sisters 30 years ago.
