You'd have to get a lawyer and sue the guy who punched you. You can sue for (a) all your medical expenses related to the injury, including anything paid by your medical insurance provider -- but the insurance company gets that cut if you win, (b) other expenses related to the injury like gas to and from the doctor's office/hospital and lost wages due to missing work, (c) all legal costs/fees, including your lawyer's fees, and (d) pain and suffering -- this one is very subjective, so don't get greedy and think you'll be able to milk this guy for a lot of money. Talk to your lawyer and decide what a fair amount for pain and suffering would be, and if he/she says anything over $10,000.00 for P&S I'd get another opinion.

You can file suit as a bodily injury claim, but the real issue is being able to collect. To be honest you will most likley get a judgement agaist him, but the court doesn't control if he pays. If he doesn't then you have to incur ither costs of performing discovery (where he works, assests), then you would have to pettetion the courts to issue a legal order to retain funds. You may recover some of the costs of your labor. To be honest you are best getting an attorney to work with you in court. Many will take the case on the basis of only getting paid when the case is settled in your favor.

"Restitution" means reimbursement for med bills, lost wages, & all your actual losses, etc. But you may be entitled to substantially more because this was an intentional injury. Suggest you contact a personal injury attorney.

You can make a bodily injury claim against the perpetrator, for any amount you wish. If your medical bills are low, you can sue him in small claims court. Take a body guard with you.

You will probably only receive medical bill and possibly pay for time you lost from work. If they're retired, disabled, etc probably nothing. The system just doesn't make it easy.........good luck. You might make a call to the prosecutor and ask.
