Sounds like the expansion valve is failing.

most compressors have a relay that tells the compressor when to click on and off, thats the next thing i would check because its apparently not the compressor thats bad, it is coming on at least some of the time and u say its full of freon

You need to get the pressures measured. Take it to a shop and have them put a set of gauges on it. You may have overfilled the gas. good luck.
