Please help! My soon to be ex and I are trying to get divorced without lawyers (amicably). We have to children and I have the kids about 70% of the time. We make the same amount of money, married for 5+ years, live in California. He currently gives me $850 a month. I do not get anything more. He kept the house (I signed it off to him). He said I shouldn't claim BOTH children on taxes but my argument is that I raise the kids majority of the time plus he is a home owner and benefits from that. He also said that I shouldn't be asking for alimony or his retirement (which is fine because I have my own 401k) Question: I really don't want to use lawyers ($$$), can anyone clearly state what I AM eligible for? Am I ripping him off or visa versa? THANK YOU THANK YOU!

It would benefit the children more if you could work things out with your husband without getting lawyers involved. They always manage to drudge up harsh feelings and words. Both of you need to make a list stating what you want, then sit down together, go over each others list....for instance say you want $1,500 a month in child support and you could explain why you felt you need that much. Then he gets to say well I don't think thats right because I can provide clothes for the kids at my house so they won't be bringing theirs from home and I can do $1,000 a month. Then you say okay or whatever. Move on the next thing on the list. Good Luck.

I need the answer to this question as well, I have been divorced for about 15 years....in the original divorce papers we were to claim the kids every other year (to be fair)....anyway he got remarried has 3 more kids (we have 2).....has only seen the kids 3 times in 8 years....and yet still claims them every other year....."because that's what the court order says he can"....That would be the ONLY thing in the court order that he follows by the way....... he ONLY pays $236 a month child support.....I don't care much about that I have my own money and will take care of the kids myself.....but how can he even have the nerve to claim them??? we fought in court for custody for more than 5 years so to go back to court makes my skin crawl, What do you do???

Aunt Andy,
sounds to me like you both (but especially you) are in need of Attorneys. Yes, they cost money, Yes they can be a pain - but you pay them to keep YOUR best interest during the discussions of these things such as divorce. You have already signed off the house and have agreed to no alimony? One or the other I could see - BUT BOTH?

YOU are being ripped off my dear; get an Attorney.

wow your giving up too much..if a divorce was written for me among the stars i would wish you divorced me too. (im kidding) .when it comes to the kids like it or not both of you are the parents & granted you spent more time but you should share that...now if he was not a good father and you feel you can proove that then thats another story...often in life the complicated questions are rather simple..BTW where in california...

You are being taken in my professional opinion.. This is unfortunately where professionals come into place... I hate lawers too but I would rather have one that deals with this day in and day out vs. you working through it through Yahoo.. I wish you the best
