If someone ended an assignment with a temp agency on a bad note, will or can the agency let the other angencys' know of the bad break up by giving bad reference. I know that this would be considered defermation of character but has this ever happened and if so how can one go about find out?

From a legal standpoint, these days the old agency can't do anything more than confirm that yes, this person worked for us from this date to that date. To do any more would be to risk getting sued for slandering you. And most temp agencies, being in the business of human resources, know this very well.

As to how to find out? That's going to be a bit trickier. You have to get your next prospective employer or temp agency to admit that they denied you work on account of something the old agency said about you, and you need to have some sort of documentation to back it up.

First, it is not defamation. Second, yes they can give a bad reference.
