we recently started moving out. we had to be out by the 30th which is tomorrow. well the landlord has called my mother who lives with us several times on her job. we went over last night to get the last of our stuff. everyone works and only one car, come to find out my landlord has had people in the apartment they have painted it and ruined some of our things and stolen stuff. my question is this.. is she legally allowed to go into that apartment before we turn in the keys. hen we got there last night she had people in there cleaning. someone stole 2 antique plates that were worth a grand or more each.she claimed we owed her money so we think she stole them. also do we have a criminal case against her

we never had the plates appraised because we never planned to sell them they were family heirlooms

No she is not allowed to go into the apartment until the first of the month and that is when you turn the keys in. If there is something missing and you had still another day or two left on your lease, then your landlord is in violation and she is liable for whatever was stolen from you. You can file a claim against her in small claims court and make sure that you have your documentation as to how much the plates where, your lease and move out notice (if you done it in writing). Also you can take photographs of everything that was ruined, and of the activity (other people) in the apartment and make sure they are the types of photographs that you get developed so that the date and time is on the back of them. You can also report her this to the police department to make sure that you have a record of it.

Typically the owner would be allowed in to show prospective tenants the apartment, but it really depends on if this issue is addressed in your lease, and on the landlord/tenant laws in your state.

As far as the missing items, I would definitely sue her in small claims court. Before doing that, make a police report on the stolen items, to include the fact that you know she was in the home and allowed cleaning people in.

Your landlord had no right to go in early. Even if you're not out , there is an eviction process. Some states have more specific rights for renters than others. I hope you have renter's insurance, but definitely talk to an attorney. There may be a non-profit group in your area if you're not trying to get more than the actual damages are or you may want to sign for pre-paid legal. Good luck.

She cannot go into the property before your time is up - which is tomorrow.

Take pictures, and take her to small claims court. And hopefully you appraisals on the plates - because very few things are worth as much as people think they are.

Yes she is allowed in before you move out. No she is not allowed to take anything because you owe money. In order to recoup any monies owed she has to take you to court. If you have documentation showing how much your plates are worth I'd sue her.
