If you were to catch a thief in your home, would it be legal if you shot him? (Killed)?

In most States down south you can shoot him if he's in your house. Further north, you can't even give a burglar a bad look or you've violated his rights. I've already checked and I they don't consider a mother-in-law a burglar in Texas - not that six rounds form a .357 Magnum would have any effect on a 341 lb frame.

A thief? You could probably get away with that, but just because someone is on your property won't cut it in court. A thief is different than a mere trespasser, because a thief is more likely to be a potential danger to you or your family. Kill a thief, and your worst case scenario is a manslaughter charge if you shot him while he was fleeing. Kill someone just for "trespassing" on your property, and you're a murderer. That said, laws vary a little from state-to-state.

It varies from state to state; but in all cases it is expected that only enough force be used to restrain the thief. Meaning, if you saw him steal a watch, you can't just kill him right off the bat. It has to be justified. He has to actually threaten your life, or give you reasonable fear for it.

legally no - anyone can come onto your property and also walk into your house.
Then you have to say - get out, you are trespassing ....
if they don't leave - call cops.

.... but on saying that if there is a violent situation going on and it's self defense .... shoot the bugger.

If I was a judge I would want to replay the whole event with perfect diagrams and account of the gunner and any living witnesses. Our panel would review all information and intentions. If it was some stalker, the state would do what it could to award you million if you pulled a clean head-shot.

If he posed a threat to your life then yes you have the right to defend yourself. As for trespassing no you couldn't shoot him you would have to call the police.

in the uk you can't or own a fire arm.

the most famous case of it was tony martin in the uk.. he dealt with his burglars, got sent to jail for it.

you can use "reasonable force" to defend yourself... me i'd take a baseball bat to them, if i had the chance. as they are probably the same losers who terrify old people in some cases.

i didn't invite them onto my property, so they enter at their own risk and waver any legal rights in my eyes.
some have the cheek to claim for assault etc from the property holder, if they weren't there in the first place its down to them being theiving herberts.

Only if you believe you or your family are in danger. Someone that broke into my home while I am here with my family stands a good chance of taking a bullet.

Ok,the correct answer is yes,it is illegal. There are ways to get around that though. If you feel your life is in danger it's ok. So,even if the intruder is unarmed,all you have to do if put a wiped down knife in their hands after they are dead. You need to make sure they are dead though. Dead men tell no tales.
