Dish Network accessed my checking account through my debit card which they were not authorized to do so. They say they have permission to do in the Residential agreement http://www.dishnetwork.com/content/about_us/residential_customer_agreement/index.shtml
If you read this it says nothing about them taking money from your account, just that you are liable to pay. Now, my ? is how do I remedy this? Since by law they can't just go into my account without my authorization right? I shouldn't have to close down my bank account because I am afraid that they will take my money at any time and being it a checking account this leaves me at risk of overdraft.... HOW DO I STOP THEM?

I should have been more specific. I am sorry. Yes to START service I gave them my debit card. I never signed up for repeat billing. My bill got lost or something and I jsut got it and than noticed on my bank statement they charged me. I called them, and the person said I authorized them to in the Residential Agreement. But when reading this fine print it says NOTHING about them withdrawing funds from my account. NOTHING...so now what?

I'd say that you signed up for their autopay plan. It's mentioned in the agreement you linked.

You remedy that by cancelling the autopay plan.

FYI, they didn't pick your debit card number out of thin air. You had to have provided it to them, most likely when you signed up for the service. By providing them with the number, you DID authorize them to bill to your debit card. Read the fine print on the agreement that the installer left with you.

my question back is "how did they get your account information?" was it just a lucky guess on someone's part?

Surely, there is more to this than you're telling us. You gave your account information to them for something you wanted at one time, didn't read the fine print at that time that probably said that, by giving them your account information, you were authorizing them to do so for future billings from them for their services.

Try calling Dish Network and work it out with them. If that doesn't resolve the issue, dispute the transaction with your card issuer (bank). First thing your bank will (or SHOULD) ask you is who you talked to and when (date, time, phone number, employee name) at Dish Network. Keep in mind that when you do this, Dish Network will remove your payment from your account with them. You will then have to choose to pay them another way or stop their service.

A debit card works differently than a credit card so you're not as well protected as you would be in a credit card charge.

You gave them your card details at some point. If you are completely unhappy with their access and you are concerned about future charges, cancel your card, not your bank account. You can always get a new card in the future.

You must have provided them with your debit card information at some point for this to happen. There's a good chance that when you provided that card, you inadvertently agreed to repeated billing. Call your bank for assistance.
