My father tried to press statutory rape charges on someone when I was 15, but the state said actually the legal age is much lower than most people think. In Colorado it was 14 (in 1993, now it is 17). The police said doesn`t matter if I had sex with a 50 year old guy, if I consented, it was perfectly OK. They do tend to go easier on the younger guys (especially under 21) even if they do have sex with an underage girl. The first time is usually just a warning or a 3rd degree sexual assult charge (same as groping or exposing yourself). This is what the police told me anyway. They take the cases with older men a lot more seriously (for obvious reasons).
Here is a website listing the States and the "age of consent" in each state...

I'm a lawyer, and guess what - the 17 year old CAN and will be prosecuted. There is not a single state where sex with a 15 year old is legal. She is not old enough to consent to sex...
Depending on what they have done together, it could be a 2nd or 3rd degree felony, and if it is prosecuted, the 17 year old can be tried as an ADULT.
When convicted, not if, WHEN...the 17 year old could face jail time, or at the least juvenile hall, and have to register as a sex offender the rest of his life.
Get it through your head - this is SERIOUS. There are no "loopholes" due to her age...the only "hole" he would have is if the parents of the girl in question dont say a word to the police.
If you want to e-mail me the state you are in I can tell you exactly what kind of trouble you can get into if you want to know.
IN RE YOUR ADDITIONAL DETAILS
here is the statute that you will wind up being convicted for -
566.068. 1. A person commits the crime of child molestation in the second degree if he or she subjects another person who is less than seventeen years of age to sexual contact.
2. Child molestation in the second degree is a class A misdemeanor unless the actor has previously been convicted of an offense under this chapter or in the course thereof the actor inflicts serious physical injury on any person, displays a deadly weapon or dangerous instrument in a threatening manner, or the offense is committed as part of a ritual or ceremony, in which case the crime is a class D felony.
Granted it is "only" a misdemeanor - but c'mon, do you really want a record just because you were horny? Find someone of your own age or older. BOTH of you have to be 17...not just one.

Your both minors, parents could possibly get a restraining order. But you both must sit down and think this out.First thing that comes to my mind PREGNANT!!!.Im guessing both of you are still in high school imagine having to give up a lot of your last few years of high school, sports dances hanging out.And what about college is that in your future. And raising a baby, you both are not that many years along since you were toddlers, but perhaps the worst is the girl always get the real hardship from this,if you care for her and each other THINK!!!! about the future.I know it sounds like Im a old fashion butt just spouting out and preaching but I been their done what you are doing and almost ruined two young lives .I was 17 once. But now im an old fart!! and I think I have earned the right to preach and if I can help a few youngsters then I guess I will keep on preaching.

Depending on where you live, it can and does happen. If the girls parents decide they are angry enough to insist that charges are laid against an older person for having sex with someone who is underage - you can bet that will happen. In some countries it doesn't even matter if the underage person admits to consent - the older person can still be prosecuted. However it depends also, as to where the 17 year old stands in the eyes of the law where they live - as an adult or not. If you are considered an adult by law - then yes, you can be charged.

I live in Florida and don't believe there is a limitation Florida Stat. Ann. §775.15 No statute of limitations for sex battery if victim reported the offense within 72 hours. Florida S 698 (2001) Tolls the statute of limitation until a victim of a sexual offense reaches age 18 when the victim is a minor, or until they report it to authorities, whichever happens first.

She is a Minor! her legal Guardians MOM and DAD.
Can put ole 17 yrs ole in jail.
Depends on the State but if the District Attn. and Child services find out 17 yrs old is in deep trouble.
if the state gets in it your toast! if the girl said they didnt do anything but said they made out it is called carnal knowledge of a minor that is big trouble.
I Know I have 13 uncles and aunts with a million kids and the girls have caused major trouble for some boys.

As long as you are both comfortable in this relationship I say the law will not come into play. At least not for the ages described here.
