ok ,my dad is a landlord and it pist me off that his tenants take advantage of him,for example they move in people that are not in the contract.They don't pay the rent on time.They yell at him.And he thinks he cant kick them out for those reasons.where can he get those papers where claim he can raise the rent every year?

Some of the laws recently changed, so I don't know if the Landlord Tenant publication is up to date. I went here

This is where the official handbook was kept online. It is now blank. I am concerned that the updated info isn't completely available yet.

Well you raise a lot of issues and questions, but without knowing the specifics - such as what the rental contracts say (or leases) lets deal with the basics.

In California no one can 'kick' anyone out of their rental unit - even if they have not paid the rent. The law requires due process to prevent abuse.

Unless there is a lease, your dad rents on a month to month basis. WHich means that either party can give the other one months notice to vacate ..WITHOUT NEEDING A REASON Does that mean that the tenants will... prob. not.

If they don't then your dad would have to deal with the eviction process and that process must be applied to each and every tenant in the unit that has resided there more then a month.. even if he did not rent to them.

Toss in rent control and city laws dealing with tenants and rent hikes and it gets even more complex.

If you are not sure about his rights (or theirs) most large cities have some kind of informational class, or brochuer for both landlords and tenants - especially if they have rent control laws.

I'm providing a link to a great website that I have used many times called California Courts: Self Help Center. If you scroll down to "more topics", you will see "landlord/tenant issues". This is a great place to go to for handling many tenant issues, including what your rights are as a landlord. Plus, if you do find yourself having to go to court, many of the forms that you will need are available right there at the same site and some are even fill-able and you just print them out and file them at the courthouse. Some will even have instructions on how to fill them out and of course there are links provided for you if more info. is needed on any of the topics.
I hope this helps you and your Dad, I have been an on-site manager before as well as a tenant fighting an eviction and have completed all the paperwork myself using this site, as well as all of my divorce paperwork.
