So let's say someone made a fake trailer that included footage from a REAL movie and put it on Youtube; even with a disclaimer would it still be copyright infringement?

Yes, this is why often when viewing one of these files on youtube they will try to disguise it using part "1337" speak or odd spacing. It is 100% illegal.
