The man I live with is 62 years old and after retiring from his job about 6 month's ago he was asked to come back part time. He worked for this company for 5 years, and was an excellent employee-not one mark agaisnt him.
Monday he tripped over a mat that was to high to begin with, and other employee's were also complaining about this mat.
He slammed into a machine, and broke 5 ribs severly, and bruised his lung.Today it will be 4 days that he has been hospitized. He has now come down with a blood clot in his lung due to the injury. Due to his oxygen level falling to 50 % and his heartbeat out of control, he is now in the Intensive care unit.
The company has informed him that through work comp, he will recive 2/3 of his pay. They will also pay his medical bills, although he is retired Navy and has his own benefits. He is a very sick man at this time.
Will this company be liable for more than his wages?

Yes of course he is.
There is pain&suffering.
Possible permanent damage to health.
Possible effect upon life expectancy.
Stress (mental welfare).
Time lost in hospital and recuperation.
Loss in earnings.
Legal fees.
etc., etc.
A good lawyer is needed. to establish the cause and prepare a list of claims. The Company will probably settle out of court to avoid adverse publicity and additional legal costs.
Some law firms specialise in this kind of claim and will indicate in advance whether or not the case will stand up and if so what compensation might be expected.
